The Barbourne Mara Limited t/a “The Manhattan” (“We”) takes your privacy very seriously and is committed to treating your personal information as private and confidential. This Privacy Policy is meant to help you understand how we collect, use, store, share and protect your personal data and how you can exercise your privacy rights. 

WHICH INFORMATION DO WE COLLECT?

We may collect, store and use the following categories of personal information about you; basic personal information such as your name; contact information such as your phone number, personal email address and postal address ; payment/ transaction information such as payment card & credit card number and mobile money transactional details; image/ videos, with your consent or from CCTV cameras at our premises; social media data; birthdates and celebrations; and any other communications that you send us. 

You must ensure that you provide us with true, complete and accurate information and notify us of any changes of such personal information.

HOW DO WE COLLECT YOUR INFORMATION?

This is information is obtained directly from you when; you visit our premises, you make your payment, you call us or visit us to book a reservation, you take part in contests, competitions or games organised by us, you interact with us on any of our social media pages, you register for and or attend functions organised by us or any of our partners, you apply for employment; you take part in a survey or submit your review or feedback; Additionally, this information may also be obtained from; third party’s such as your authorised representative, our service providers that are assisting us in providing you with a service e.g. marketing partners or food delivery platform; our systems such as Wi-Fi when you use our internet connection; when we take your photo or video (with your consent); through CCTV footage and or any other publicly available sources.

REASONS FOR COLLECTING SUCH INFORMATION.

The legal basis for processing the personal information that you provide will be used for the following purposes (“The Purposes”):

  1. Performance of a Contract. This includes to provide and maintain our service, to process reservations, to process your payments for the service we have provided, to tailor your experience, to enable your participation in our contest when you choose to do so, to communicate with you about the service and to address comments, questions, complaint, and otherwise provide you with the appropriate customer service, to process your application for employment.
  2. Legal, Regulatory, Tax, Accounting and Reporting obligations. We may process your data to fulfil our legal, regulatory, tax, accounting and reporting obligations as well as for the establishment, exercise or defence of a legal claim
  3. To protect our legitimate interests and your vital interests. This includes activities such as detecting, preventing and or otherwise addressing/managing security, risk, fraud, and crime; for our business operations.
  4. With your consent, we may use your data to provide you with relevant marketing & offers which we believe may be of interest to you. Additionally, we may capture and share your photos or video on our social media pages with your consent.
  5. We may ask for your feedback through subjective surveys to enhance our services and ensure business continuity.

We shall not process your personal data for any other purposes other than The Purposes indicated above.

WHO DO WE SHARE YOUR PERSONAL INFORMATION WITH?

We may share your information with some of our service providers such as; our technical support and third-party software providers who assist with our ICT infrastructure; payment processing providers; data analysers; marketing messaging delivery providers; delivery service providers, professional advisors such as our lawyers, accountants, tax advisors and auditors as and when needed; to any of our affiliated business/companies; in case of a merger or acquisition to the third party who acquires any party our business, law enforcement or regulatory bodies when required by the law. These third parties have only been authorised to process your data in connection with The Purposes and we require them to maintain and implement adequate security measures to protect your personal information.

PHOTOGRAPHY AND VIDEOGRAPHY

We shall not take and or post your image/video on our social media pages without your consent.  We are committed to following the procedures outlined in our consent notice which is prominently displayed at the entrance of our premises to seek your permission before taking and posting your image or video on our social media pages. Additionally, we will also obtain your consent before we send you any marketing communications.  You have the right to withdraw your consent at any time by contacting us at hello@manhattan.co.ke Please note ,however, that withdrawing your consent will not affect the legality of any processing activity undertaken prior to the withdrawal e.g in relation to any image, video or audio that have already been shared or circulated by third parties.

If you choose to personally share your photos or images taken on our premises on social media platforms including those on which we have a presence, we kindly ask you to respect of the privacy needs of others who may appear in your content. Please be mindful of what you choose to share and make public. It is important to note that we cannot control the privacy or security of the information you choose to make public or share with others. As we do not control the privacy practices of the third parties platforms you choose for sharing images and videos, we encourage you to contact them directly to learn about their privacy policies and practices.

HOW LONG DO WE KEEP YOUR DATA?

We will only keep your personal data for as long as is necessary for the purposes that it was collected as informed by legal/regulatory requirements’, our internal policies or where the data is necessary for the establishment, exercise or defence of a legal claim.

WHAT ARE YOUR DATA PROTECTION RIGHTS?

You have the following data protection rights;

  1. Right be informed on the purpose for which we are processing your personal data;
  2. Right to access your personal data in our custody;
  3. Right to object to the processing of your personal data;
  4. Right to request that we correct your personal data if it is inaccurate, false or misleading;
  5. Right to deletion of your personal data; and
  6. Right restrict the processing of your personal data.

CHILDREN DATA

We do not knowingly collect children personal data as our services are not offered to persons under 18 years of age. If we discover that we have collected personal data belonging to a child, we shall immediately dispose the same.

SECURITY OF YOUR PERSONAL INFORMATION

We aim to keep your personal information safe by implementing a rigorous system of organisational and technical measures across all our IT and physical locations. These measures are designed mitigate the risks of data loss, misuse, unauthorised access, disclosure, alteration and or destruction of your personal data. However, despite our best efforts, we cannot provide an absolute assurance of the security of your data especially in the event of a breach caused by factors beyond our control.

This policy may be updated from time to time to reflect any changes in our privacy practices or change in law.
